1. General terms and conditions of the online store barrastejadilho.pt

1.1. These terms and conditions are an agreement between barrastejadilho.pt and you ("user", “you” "customer", "your", or "client"). This Agreement sets forth the general terms and conditions of your use of the barrastejadilho.pt website and any of its products or services. The online store barrastejadilho.pt is owned by the company Norsigma Unipessoal, Lda, with it's headquarters at Rua Santa Luzia, 849, 1 B, 4250-420 Porto, registered under the number of a Portuguese legal entity PT 513139222, with a share capital of 5.000,00€, from now on called barrastejadilho.pt.


1.2. The service consists, in an online store which, in addition to providing information about a set of products and/or services, allows users to electronically order products disclosed therein, under these terms and conditions.

1.3. barrastejadilho.pt reserves the right to modify these terms and conditions, without prior notice, and any modifications will be published on this site.

2. Products and contents

2.1. barrastejadilho.pt will do everything to ensure that the information displayed does not contain errors and that is as accurate as possible, and any error will be quickly fixed, whenever detected.

2.2. All information available on prices, specifications, products, promotions and services may be changed whenever necessary and at any time by barrastejadilho.pt, without prior notice.

2.3. barrastejadilho.pt will do everything to make sure that the images displayed on its online store are as identifying as possible of the final products, however, the images here displayed are only illustrative, and the customer should always consult the product description before placing any order.

2.4. Product descriptions are made in accordance with the specifications described by the respective supplier. barrastejadilho.pt is not responsible for any information contained in product descriptions or on users comments, or reviews.


3. Orders

3.1. Any order on this website must be made by users aged 18 (eighteen) or over 18 years old.

3.2. All elements and information filled and transmitted by the user will have full legal effects, in order to fulfil the obligations assumed herein.

3.3. By placing an order on this website, the user agrees to accept the terms and conditions, as amended at the time of the respective order.

3.4. Orders placed through this online store are subject to payment obligations.

3.5. All orders will be sent except in rare situations where some products might be out of stock or with a typographical error in the announcement of product's descriptions.

3.6. To place an order, the user must check all the features and specifications described on this website and if the user wants to proceed, should add the item(s) to the shopping cart and finally, go to the shopping cart tab. To complete the order, the user must confirm all data such as the shipping address and choose the payment option.

3.7. Before ending the order, the user will review all the products added to the cart, and user can always correct any lapses.

3.8. barrastejadilho.pt will always do everything, in order to send all the ordered products, although it is possible that, in certain cases, due to unforeseen circumstances and causes beyond the control of barrastejadilho.pt, that will not be possible. If this happens, after placing the order, we will inform the customer, by e-mail or by cellphone, presenting him with the possibility of canceling the order. In cases where payment for the order has already been processed, a refund will be made.

3.9. When registering an order on the website, the customer will receive a confirmation email. The order must always be confirmed through the respective payment. Once the payment is made and the order is processed, an email will be sent with all the information necessary to track the order.


4. Payments

4.1. The prices shown at barrastejadilho.pt, referring to each product, are valid for the current day on which they are announced, remaining active for the customer who orders the respective article and pays on the same date, even if he receives the order after that day.

4.2. At barrastejadilho.pt you can choose between the following payment methods:

- Credit Card
- PayPal (Payments made through this option will be forwarded to the respective platform)
- Bank transfer

4.3. All product prices shown on barrastejadilho.pt are presented in euros (€) and include VAT, accordingly with the Portuguese law.

4.4. Shipping costs will be added to the price of each order placed on barrastejadilho.pt. 
To check the final shipping price, please note that you will need to add the final delivery address.
Shipping costs will be shown in the order summary.
Before completing the order, the customer must confirm all the information.



5. Deliveries

5.1. We expect that all orders will be delivered within a maximum period of 30 days, since the day following confirmation of payment by barrastejadilho.pt, without prejudice to the provisions of these terms and conditions.

5.2. barrastejadilho.pt declines any responsibility for the delay or impossibility of delivering orders due to error or insufficiency of information transmitted by the customer. If any of the data is incorrect or insufficient, and for this reason there is a delay or impossibility in processing the order, or eventual non-delivery, the responsibility of this issue will be from the customer.



6. Returns and cancellation of orders

6.1. In case of non-compliance, barrastejadilho.pt reserves the right to cancel any order. In case of payments by bank transfer, the cancellation will be made 2 days after the order is placed, if the payment is not processed.

6.2. The customer may terminate the contract, without the need to mention the reason and without penalty, within 14 (fourteen) consecutive days, counting from the day following the date of product delivery.

6.3. To enforce its right of free resolution, the customer must proceed in accordance with the provisions of these terms and conditions.

6.4. The consumer's right of free withdrawal is deemed to have been enforced within the period when the declaration of withdrawal is sent within a period of 14 (fourteen) consecutive days, counting from the day following the date of delivery of the ordered product.

6.5. If the customer enforces his right of free resolution electronically, barrastejadilho.pt will acknowledge receipt of the declaration of resolution by email, within 48 hours of receipt (working days).

6.6. If the customer enforces the right of free resolution, the customer will be refunded the amount paid for the order, within a maximum period of 14 (fourteen) consecutive days, counting from the date on which barrastejadilho.pt was informed of the decision to terminate the contract, without prejudice of the provisions of these terms and conditions. If the item was already sent to customer, the refund will be made only after barrastejadilho.pt receives the items in perfect conditions. There will not be any refund for shipping costs.

6.7. The reimbursement of these amounts will be made by the same means of payment used in the initial transaction.

6.8. The customer must return or deliver the products to barrastejadilho.pt within 14 (fourteen) consecutive days, counting from the date on which he announced the decision to terminate the contract, with the respective invoice.

6.9. The return will only be accepted in cases where the products are received by barrastejadilho.pt in perfect condition, without any use and properly packed in the original box, including all manuals and their components.

6.10. barrastejadilho.pt is allowed to withhold the refund while the items are not fully received.

6.11. Any cost regarding to returning items will be borne by the customer.

6.12. Items to be returned must be received by barrastejadilho.pt in perfect packaging and conditions. If this doesn't happen, the customer will be held responsible for the deterioration of the items.

6.13. barrastejadilho.pt reserves the right to cancel the order in case of any errors detected or malfunctions.

6.14. If for any reason there is a supervening unavailability of the ordered items, barrastejadilho.pt may cancel the order. If this happens, the customer will be informed and refunded of the paid mounts, within a maximum period of 3 days from the date of the knowledge of the unavailability.


7. Customer support, warranty and after-sales service

7.1. For support or clarification of any matter related to the online store barrastejadilho.pt, or to your order, or if you are nor satisfied with your order, without prejudice to the customer's right of free resolution, if you wish, you can send us a written note by any of the contacts displayed in these terms and conditions and on the website barrastejadilho.pt, or through the contact form available on the website. We will try to reply within two business days.

7.2. The products we sell have a warranty period defined in accordance with legal terms of 3 (three) years. This period is counted from the date of the purchase invoice for the products and can be exercised upon presentation of the invoice. For commercial clients, the period will be 2 (two) years.

7.3. If the customer detects any nonconformity within the legal period, the customer must report it to customer support, within two months of the date on which the user has detected it. This communication must mention the respective order number and the detailed description of the non-compliance.

7.4. While using the product, deteriorations may arise that may be related to normal usage and tear of the product, or even to misuse or neglected maintenance, which are not covered by the warranty. Upon receipt of the returned product, barrastejadilho.pt carries out a technical verification with the supplier. In case of non-compliance of the product with the contract, the product will be replaced or repaired, without additional costs for the customer. On the other hand, if the technical verification detects signs of misuse or poor installation by the customer, the customer will be contacted and informed that barrastejadilho.pt will not assume any responsibility for that.


8. Data Protection

8.1. When registering as a customer, the website barrastejadilho.pt will collect personal data for billing and delivery of the ordered products.

8.2. The company Norsigma Unipessoal, Lda will be responsible for the data processing and here it is stated that your contact details and address will be transmitted to the carriers of the orders.

8.3. As far as possible, barrastejadilho.pt guarantees the confidentiality of all data provided by its customers.

8.4. By registering or placing an order, you are consenting to the processing of your personal data in the terms set out in these general terms and conditions.

8.5. Under the terms of the applicable legislation, the customer is guaranteed the right to access, rectify and update their personal data. For this purpose, please send an email to [email protected].

8.6. Customer should never share the password or registration data with third parties. By doing so, customer assumes responsibility for any damage that may occur from this sharing.

8.7. As a reminder, please note that the internet is an open network, so, users personal data and other personal information and content hosted on the service provided may sometimes travel on the network without security conditions, and there may be a risk of unauthorised access and use by third parties. In these cases, barrastejadilho.pt cannot be held responsible for such improper access and/or use.


9. Applicable law and resolution of disputes

9.1. The terms and conditions here stated are governed by the Portuguese law.

9.2. In the event of a dispute, the customer may file a complaint through the Online Dispute Resolution Platform.
